Spousal support is one of the most emotionally charged parts of a divorce, and one of the most misunderstood. In Montana, alimony is called maintenance, and contrary to what many people expect, it is never automatic. Whether you might pay it or receive it, understanding the actual legal standard is the key to a fair outcome.

The Montana Standard: MCA § 40-4-203

Maintenance in Montana is governed by MCA § 40-4-203, and the court applies a two-part threshold before it can award anything. A spouse must show that they:

  1. Lack sufficient property, including their share of the marital estate, to provide for their reasonable needs; and
  2. Are unable to be self-supporting through appropriate employment, or are the custodian of a child whose circumstances make working outside the home inappropriate.

Only when both are satisfied does the court move on to decide how much and for how long.

How Amount and Duration Are Set

There's no fixed formula. Once the threshold is met, the court considers factors including the time and training the spouse needs to become self-supporting, the standard of living established during the marriage, the length of the marriage, the age and physical and emotional condition of the spouse seeking support, and the paying spouse's ability to meet their own needs while paying. The result is tailored to the specific marriage.

Rehabilitative by Design

Montana maintenance is frequently rehabilitative, designed to support a spouse for a set period while they gain the education, training, or work history to stand on their own. Longer or indefinite awards are possible, especially after lengthy marriages or where age or health genuinely limits earning capacity. Either way, the award should reflect real need, not assumption.

Modifying Maintenance

Circumstances change, and so can maintenance. When there's a significant, continuing change (a major income shift, a serious health issue, or another development that makes the current terms unfair), we can pursue or defend a modification.
