Biography

Misty D. Gaubatz is a Partner and co-founder of A&M Law in Missoula, Montana. Hundreds of Montanans have entrusted her to help them through the hardest moments of their lives: divorce and custody disputes, criminal charges, DUI arrests, and serious injuries. Roughly half of her practice is devoted to family law, with the balance split between criminal defense and DUI defense. Whatever the issue, clients describe the same experience: a calm and steady lawyer who out-prepares the other side and understands that every case is unique and every client is an individual.

Misty earned her Juris Doctorate from the Alexander Blewett III School of Law at the University of Montana, where she also earned a Certificate in Mediation. Before law school, she completed a Bachelor of Arts in English Literature and American History at San Francisco State University, and her background in close reading and critical thinking shows up in every brief she writes.

As a former Clinical Law Clerk for U.S. District Judge Donald W. Molloy in the District of Montana, Misty developed an inside understanding of how courts operate and how judges think. She draws upon this knowledge every day for her clients. She is admitted to practice before the United States Federal Court in addition to every level of Montana's state court system.

Misty was admitted to the Montana Bar in 2020 (Bar #12234), and she has worked in law for more than two decades.

Together with Ashley Hurlbert, Misty co-pioneered the Cooperative Family Law program, an amicable approach to divorce and parenting matters that resolves disputes without the cost, delay, and damage of adversarial litigation. As a Certified Mediator, she has guided numerous families to durable agreements at the table instead of in a courtroom. She has also served as a Court-appointed Guardian ad Litem, advocating for the best interests of children in contested family matters.

Outside the office, Misty volunteers as a Caring Companion with Missoula Aging Services, has volunteered with the International Rescue Committee, sponsors the Missoula Community Chorus, and has served as a Hearings Officer for the Missoula Housing Authority. Misty has called Montana home for more than 20 years. In her free time, she enjoys hiking, kayaking, making music, speaking Spanish, and spending time with her spouse of over 25 years and their amazing son.
