Montana's Premarital Agreement Law

Montana has adopted the Uniform Premarital Agreement Act, found in Title 40, Chapter 2 of the Montana Code Annotated. It sets the ground rules for what a prenup can do and what makes it enforceable. At its core, a valid agreement must be in writing, signed by both parties, and entered into voluntarily.

What a Prenup Can, and Can't, Do

A well-drafted Montana prenup can address:

  • How property and debts are characterized and divided
  • Each spouse's rights in the other's property, including a business or inheritance
  • Spousal support (maintenance), within legal limits
  • Estate and death-benefit arrangements

What a prenup cannot do is predetermine child support or custody. Those are always decided in the child's best interests at the relevant time, regardless of what a couple agreed to beforehand.

What Makes It Enforceable

Enforceability comes down to fairness and process. The agreement must be entered into voluntarily, with full and fair financial disclosure (or a knowing, valid waiver of disclosure). Agreements signed under last-minute pressure, without disclosure, or without the opportunity to consult a lawyer are the ones that get challenged, and sometimes thrown out. Building it correctly is the entire point.
